SONNENHOF - GENERAL TERMS AND CONDITIONS
I. General conditions
1. these general terms and conditions apply to all contracts concluded with the hotel, provided that they fulfil the characteristics of the AGBG. They may be partially replaced by conditions negotiated in individual cases.
2. the customer or guest bears the sole liability risk for objects or materials left behind in generally accessible rooms, in the technical facilities or event rooms of the hotel. Liability can only be accepted in the room if it concerns the customer's personal belongings that he/she effectively needs at the time of using the room. Liability must be limited to the extent permitted. Valuables such as jewellery, cash, fur coats etc. must be deposited with the hotel reception, whereby a separate safekeeping agreement must be concluded with an authorised person. The hotel accepts no liability for valuables not deposited.
3. all price labelling and agreements are in EURO (EUR). Where foreign currencies are quoted, this is for guidance only and is based on the exchange rate valid at the time of publication.
4. insofar as the customer is provided with a parking space in the hotel car park or the hotel garage - even for a fee - this expressly does not constitute a safekeeping agreement. The hotel is under no obligation to monitor the car park.
II Conditions for overnight stays
1. a contract is concluded when the order is followed by an identical confirmation. In the case of hotel accommodation, the accommodation contract (guest accommodation contract) is also deemed to have been concluded if the room has been made available without prior confirmation. The conclusion of the accommodation contract obliges both contracting parties to fulfil the contract, regardless of the duration of the contract. The contract cannot be cancelled unilaterally.
2. reserved rooms are available from 15:00 on the day of arrival and until 11:00 on the day of departure. The hotel rooms are held for guaranteed bookings. For non-guaranteed bookings, the room entitlement expires at 18:00 on the day of arrival.
3. the room prices shown include VAT and service charge and refer to the service period of one day.
4. the invoice amount is due immediately upon receipt of the invoice without deduction in cash.
5. the hotel is free to accept credit cards in any case, irrespective of the general acceptance references displayed. Credit cards, cheques and other means of payment are only accepted on account of performance. The due date for cash payment is not affected by the acceptance of these means of payment.
6. if the period between conclusion of the contract and utilisation of the service exceeds four months and the price charged for the service changes, the agreed price may be increased accordingly, but by a maximum of 10 %.
7. a refund of paid but unutilised services or partial services is not possible.
8. in the event of late payment, the hotel is entitled to charge an interest rate of 4 % above the valid Bundesbank discount rate.
9. if the invoice amount exceeds EUR 500, a total invoice can be sent at the customer's request. Invoices are payable within 10 days of receipt. Payment of individual invoices may be requested in advance by the hotel.
10. default in payment of even one invoice shall entitle the hotel to suspend all further and future services for the customer. The hotel shall decide on this without prior notice.
11. the hotel reserves the right to issue an interim invoice for a stay of more than six days or an invoice amount of more than EUR 250.
12. if the purchaser is not simultaneously a customer or guest, or if he orders at the expense of another, both shall be liable as joint and several debtors.
13 The hotel endeavours to carry out wake-up calls with the utmost care. However, claims for damages arising from any failure to do so are excluded.
14. messages, mail and consignments of goods etc. intended for the customer shall be handled with the utmost care. The hotel will store, deliver and, if requested, forward such items for a fee. However, liability for loss, delay or damage is excluded.
15. items left behind by the customer will only be forwarded at the request, risk and expense of the customer. The hotel undertakes to keep such items for six months. Thereafter, they will be handed over to the local lost property office if they have a recognisable value.
16. the hotel may refuse to fulfil its obligations until the consideration due has been paid.
17. extraordinary cleaning costs or damage to the hotel/room inventory will be charged to the guest accordingly.
18. declarations of cancellation are in writing before expiry of the deadlines. The following deadlines and cancellation fees apply for individual overnight stays (maximum 3 rooms): Cancellation free of charge up to 7 days before arrival. The following deadlines and cancellation fees apply to group bookings (more than 3 rooms) and bookings of function rooms, event packages, menus, buffets and other catering services: Cancellation up to the 45th day before arrival - free of charge; 30th day before arrival - 30 % of the agreed price; 15th day before arrival - 50 % of the agreed price; 14th day to day of arrival - 100 % of the agreed price. The liability for the unused service is reduced by 20 % of the respective liability amount as a saving of expenses.
III Special conditions for holidaymakers with dogs
In order to enable all our guests to have a pleasant and relaxing stay, we must ask our "holidaymakers with dogs" to observe and comply with the following points:
1. dogs must always be kept on a lead within the hotel. This measure also applies to the hotel's own outdoor facilities.
2. well-behaved dogs are allowed to make themselves comfortable under the table in our restaurant. Exception rule: the gallery area - four-legged friends are not allowed there. This rule also applies to the breakfast room.
3. the wellness area and the associated outdoor facilities are also not accessible to animals.
4. we consider it a matter of course that our "guests with dogs" bring their own blankets and dog baskets and that the dogs only stay in these. Keeping your dog in our hotel beds is prohibited and may result in additional costs.
IV. Special conditions for events, room hire, packages, menus, buffets and other catering services
1. a contract shall be deemed concluded when the hotel has issued an order confirmation. The order and order confirmation must be in writing.
2. the person acting as such vis-à-vis the hotel shall be deemed to be the organiser, regardless of whether or not they are authorised to act as a representative. In case of doubt, he shall be jointly and severally liable with the actual organiser.
3. if the organiser is a political, ideological or religious association, Scientology groups and/or their front organisations or similar, the express prior written approval of the hotel management is also required for the contract to be valid. If the organiser conceals from the hotel that it is such an organisation or similar. The hotel is entitled to cancel the contract and to claim at least the agreed prices as compensation. The same applies if the nature of the event could jeopardise the reputation or safety of the hotel or hinder the smooth running of the business.
4. subletting or re-letting by the organiser requires the express prior written consent of the hotel.
5. the service comprises the partial services specified in the order and which have become binding with the order confirmation.
6 The reserved rooms are available to the organiser for the duration of the period agreed in writing. They must be vacated and properly handed over at the end of the event.
7. the last number of participants stated in writing by the organiser up to three working days before the start of the event shall be deemed binding and shall form the basis for calculation. This also applies in the event of a downward deviation, i.e. a lower number of participants than stated. In the event of an upward deviation of more than 10 %, the hotel cannot guarantee that the agreed service can be provided. In this case, the hotel is also entitled to increase the agreed price accordingly. The cancellation deadlines and fees specified in the regulations for overnight stays apply accordingly.
8 The hotel is entitled to demand an advance payment from the organiser.
9 The organiser may not bring their own food or drinks to events. In special cases, a special written agreement can be made. In this case, the hotel is entitled to charge a service fee or corkage fee.
10. for evening events, the hotel reserves the right to charge a night surcharge after 11.00 pm.
11. should faults or defects occur in the technical or other facilities provided by the hotel, the hotel shall endeavour to remedy the situation immediately. A withholding or reduction of payment cannot be derived from this. Insofar as the hotel procures technical or other equipment from third parties for the organiser, it shall act in the name and for the account of the organiser.
12. the organiser shall be liable for the careful treatment and proper return of the rooms and facilities, and shall indemnify the hotel against all third-party claims arising from the use of the rooms and facilities. The installation of decorative material or other objects is not permitted without the express prior consent of the hotel. Should such consent be granted, the customer shall guarantee that such decoration material or similar complies with fire regulations. The organiser shall be liable for damage of any kind without proof of fault.
13. newspaper adverts or other publications containing invitations to events stating the name and address of the hotel generally require the prior express written consent of the hotel. If such a publication is made without the hotel's consent, the hotel reserves the right to cancel the event, even at short notice. Any costs incurred or claims for damages shall be borne by the organiser.
14. the customer must obtain any official authorisations required for an event in good time and at his own expense. The customer shall be responsible for complying with public-law requirements and other regulations. Any fees payable to third parties for the event (in particular GEMA fees or similar) must be paid directly to the creditor.
15. the costs for the disposal of packaging material or similar will be invoiced separately to the organiser if he does not dispose of the material himself.
16. in the event of force majeure, strike or similar, the hotel is entitled to withdraw from the contract without incurring any liability for damages.
V. Liability
1. the provisions of §§ 701 to 703 BGB apply. Liability for other reasons is excluded, unless the damage was caused by gross negligence or intent on the part of the hotel or its vicarious agents.
2. if the contractual partner is a registered trader, he shall be fully liable for all contractual obligations, including those of participants or guests.
VI Other regulations
1. the place of fulfilment and payment is the registered office of the hotel.
2. the place of jurisdiction is the registered office of the hotel. If a contractual partner fulfils the requirements of § 38 para. 1 ZPO and has no general place of jurisdiction in the Federal Republic of Germany, the place of jurisdiction shall be the registered office of the hotel.
3. the law of the Federal Republic of Germany shall apply.
